Negligence or Unintentional Error. Are They The Same?




Today we have an example of this with a couple of control panels recently installed (not by us, obviously) at a customer’s site. The control panels were assembled and quality checked before shipping to a third party to use in the verification of the mechanical side of the system.

Once the mechanical was verified to be acceptable per the contract, the panels were delivered to the end user. Automated Concepts was on site at the third party location and took part in the initial factory acceptance test (FAT) performed on the mechanical system (August 2024). During this time, no damage was observed on any of the panels being used for that systems FAT by Automated Concepts personal. The issue that we found when we arrived on site 11/05/2024 to do some cable installation and terminations for the upcoming startup/commissioning was that it appeared the control panels were dropped and damaged. The drop was significant enough to break the DIN rail mounts on an NTRON network hub and a ABB 5VDC power supply. The drop also knocked out three terminal block jumpers and ejected an IDEC relay from its base.


Now the questions are: Who should be responsible for this damage? Is there documented proof of known damage to the control panels before mounting? Were there deviations from the Standard Operating Procedure (SOP)?
